Who you are buying from

The seller is Orchestr Aerospace Inc., 2211 Michelson Dr, Suite 900, Irvine, CA 92612, USA (“Orchestr Aerospace”, “we”). Email: contact@orchestrsim.com.

These terms apply to hardware pre-orders placed at orchaerospace.com/shop and to Jeb's Pro subscriptions. If you buy as a consumer, nothing in these terms takes away any right you have under the mandatory consumer-protection law of the country or province where you live. These terms are available in English and in French; you may rely on either version.

Pre-orders and deposits

Our hardware is still in development and is offered for pre-order. Specifications, estimated prices and estimated ship dates shown in the shop are our best estimates and may change. When you check out we confirm your pre-order by email with an order number. A pre-order reserves a production unit for you; it is a conditional sale, described below.

Deposit. You pay a deposit at checkout through Stripe. The deposit is refundable in full at any time before your unit ships, for any reason: email us with your order number and we refund it to your original payment method within 14 days.

Balance. Before your unit ships we invoice the balance, which is the final price less your deposit, together with any taxes and shipping charges. We do not ship until the balance is paid. If you decide not to pay the balance, we cancel the pre-order and refund your deposit in full. If the final price is higher than the estimated price shown when you pre-ordered, we tell you before invoicing and you may cancel for a full refund.

Reservations without payment. When online payment is not open, you can reserve without paying. No money is taken; we email you to confirm before any payment.

We check every order against export-control and sanctions rules before shipping. If we cannot lawfully ship an order, we cancel it and refund everything you paid.

FCC authorization and conditional sale

These devices have not been authorized as required by the rules of the Federal Communications Commission. They are not, and may not be, offered for sale or lease, or sold or leased, until authorization is obtained. This is a conditional sale: the equipment is subject to the FCC's rules, and delivery to you depends on it successfully completing the FCC authorization process. FCC rules do not address consumer protection, contract or other federal or state law that may apply to this sale. If a device is not authorized, it will not be delivered and your full deposit will be refunded; you may also cancel for a full refund at any time before it ships. Orchestr Aerospace keeps ownership of each unit until it is authorized and delivered. Canadian (ISED) certification is in progress as well.

Prices, currency, taxes and duties

Prices and deposits are shown and charged in Canadian dollars (CAD). If your card is in another currency, your card issuer may apply its own exchange rate and fees.

Estimated prices do not include sales taxes (such as GST/HST, QST, U.S. sales tax or VAT), shipping, or import duties. The taxes and shipping charges that apply to your order are added to the balance invoice and shown before you pay it. For deliveries outside Canada, the destination country may charge import duties, VAT and customs fees on arrival; we tell you before you pay the balance whether these are included or collected by the carrier.

Shipping and delivery

We ship to: Canada, United States, United Kingdom, France, Germany, Netherlands, Belgium, Switzerland, Australia, New Zealand, Japan, South Korea, Taiwan and Singapore. Some products ship to fewer countries because of export controls (DeepVision EVS Mk. 1: Canada and United States).

Estimated ship dates: DeepVision EVS Mk. 1: Estimated Q3–Q4 2027; Flight Computer Mk. 1: Estimated Q2 2027; DeepBCI Mk. 1: Estimated Q2 2027; DeepSDR Mk. 1: Estimated Q2 2027. These are estimates, not guaranteed dates. We email you when your unit ships, with tracking. If your unit is delayed, you can still cancel for a full refund at any time before it ships.

Ownership and risk of loss pass to you when the unit is delivered to you.

Right of withdrawal (consumers in the EU and UK)

If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from a hardware purchase within 14 days without giving any reason. This is in addition to your right to cancel at any time before shipment.

The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, take physical possession of the goods. If several items in one order are delivered separately, it expires 14 days after you receive the last one.

To exercise the right of withdrawal, tell us of your decision by a clear statement, for example an email to contact@orchestrsim.com or a letter to Orchestr Aerospace Inc., 2211 Michelson Dr, Suite 900, Irvine, CA 92612, USA. You may use the model withdrawal form below, but you do not have to. It is enough to send your notice before the withdrawal period expires.

Effects of withdrawal. We refund all payments received from you, including the cost of standard delivery, without undue delay and no later than 14 days after the day we are informed of your decision. We use the same means of payment you used, unless you expressly agree otherwise, and you will not pay any fee for the refund. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.

Please send the goods back to us without undue delay and in any event no later than 14 days after you tell us of your withdrawal. We will give you the return address. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Warranty and legal guarantees

Consumers in the European Union benefit from the legal guarantee of conformity for at least two years from delivery: if a product is not in conformity with the contract, you are entitled to have it repaired or replaced free of charge or, failing that, to a price reduction or a refund. Consumers in the United Kingdom have the rights given by the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose and as described). These terms do not limit those rights.

Consumers in Quebec keep all their rights under the Consumer Protection Act and the Civil Code of Québec, including the legal warranty that goods are fit for their purpose and durable for a reasonable time. Consumers elsewhere, including in the rest of Canada, the United States, Australia and New Zealand, keep the guarantees given by their local consumer law.

Any additional warranty we offer with a product is described with that product and is given on top of these legal rights. To make a claim, email contact@orchestrsim.com with your order number and a description of the problem.

Intended use and safety

Our electronic flight bag software and hardware are advisory only. They are provided for situational awareness and flight planning, are not certified avionics, and are not for primary navigation. Always cross-check official charts, the current AIS or FAA briefing, and your aircraft's certified instruments. The pilot in command remains responsible for the safe conduct of every flight.

DeepBCI Mk. 1 is for research and education and is not a medical device. Transmitting with DeepSDR Mk. 1 requires the appropriate licence where you operate. Copilot and ATC transcription use AI and can be wrong; verify with official sources.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for losses caused by using our products contrary to their intended use, including as a primary navigation source. To the extent permitted by law, our total liability for any order or subscription is limited to the amount you paid for it.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, under product-liability law, or any other liability that cannot be excluded or limited by law. In particular, these limits do not apply where mandatory consumer law, such as that of the EU, the UK or Quebec, does not allow them.

Jeb's Pro: purchases in the App Store and Google Play

Jeb's Pro unlocks additional features in the Jeb's apps. If you subscribe inside an iOS or Android app, the purchase is made with Apple or Google and is governed by their terms: billing, automatic renewal, free trials, cancellation and refunds are handled by the store. You can manage or cancel the subscription in your App Store or Google Play account settings, and refund requests go to Apple or Google.

Jeb's Pro on the web

Billing. When Jeb's Pro is offered on orchaerospace.com, you subscribe through Stripe. The price, the billing interval (for example monthly or yearly) and any applicable taxes are shown before you confirm, and your payment method is charged at the start of each period.

Automatic renewal. Your subscription renews automatically at the end of each period at the price then in effect until you cancel. We tell you in advance of any price change, and you can cancel before the new price applies.

Cancellation. You can cancel at any time from your account or by emailing contact@orchestrsim.com. Cancellation takes effect at the end of the current paid period, and you keep Pro until then. Except where the law requires otherwise, we do not refund partial periods.

Free trial. If a free trial is offered, its length is shown before you start. You are not charged until the trial ends, and you can cancel before then at no cost. When the trial ends, the paid subscription starts automatically unless you have cancelled. One trial per person.

Right of withdrawal for consumers in the EU and UK. You have 14 days from the day you subscribe to withdraw from the contract without giving any reason, using the contact details or the model form above. Because Jeb's Pro is unlocked straight away, at checkout we ask you to (1) expressly request that Pro starts immediately, during the withdrawal period, and (2) acknowledge that you lose your right of withdrawal once the digital content has been supplied. If you give this consent and acknowledgement, your right of withdrawal ends when Pro is unlocked for the digital content. To the extent Jeb's Pro is a service, you may still withdraw within the 14 days and we refund your payment minus an amount proportionate to the time Pro was active before you told us. If you do not give the consent, Pro starts only after the withdrawal period. A withdrawal during a free trial costs nothing.

Regional prices. In some countries we offer Jeb's Pro at a lower regional price, based on where you are when you check out. A regional price must be paid with a card issued in one of those countries, or with a local payment method from one of them. If the payment comes from elsewhere, we cancel the purchase and refund it in full automatically, and Pro is not unlocked; you can then buy at the standard price.

Governing law and disputes

These terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country or province where you live, and you may bring proceedings in the courts of your place of residence.

If you have a problem, please contact us first at contact@orchestrsim.com; most issues can be resolved quickly that way.

Changes to these terms

We may update these terms. The version in force when you place an order applies to that order. For subscriptions, we tell you of material changes in advance, and you can cancel before they take effect.
